Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, games, and other services (collectively, the "Services") provided by The Banana Standard LLC ("Banana Standard," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms apply across all of our products, including Color Lock, RetroFantasy, and the thebananastandard.xyz website.

1. Acceptance of Terms

By creating an account, downloading an app, or otherwise accessing any of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use the Services. If you are between 13 and the age of legal majority in your jurisdiction, you may use the Services only with the consent of a parent or legal guardian. We do not knowingly collect personal information from children under 13.

3. Account Registration and Security

Some Services require an account. You agree to provide accurate information during registration and to keep it current. You are responsible for safeguarding your credentials and for any activity under your account. Notify us promptly at anthony@thebananastandard.xyz if you suspect unauthorized access.

4. Acceptable Use

When using the Services, you agree not to:

  • Violate any applicable law or regulation.
  • Infringe the intellectual property, privacy, or other rights of others.
  • Upload, transmit, or distribute malware, spam, or harmful code.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Reverse engineer, decompile, or otherwise attempt to extract source code, except where applicable law expressly permits.
  • Use the Services to harass, threaten, or harm others.
  • Cheat, exploit bugs, or use automated tools to gain an unfair advantage in our games.
  • Interfere with or disrupt the integrity or performance of the Services.

5. User Content and License

You retain ownership of any content you submit through the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use that content as reasonably necessary to operate, provide, and improve the Services.

You are solely responsible for your User Content and represent that you have the rights necessary to grant the license above. We may remove User Content that we believe violates these Terms, applicable law, or the rights of others.

6. Intellectual Property

The Services, including all software, designs, text, graphics, logos, trademarks, and other content provided by us, are owned by The Banana Standard LLC or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved.

7. Third-Party Services

The Services may link to or integrate with third-party services (such as app stores, hosting providers, or analytics tools). We are not responsible for the availability, content, or practices of third-party services, and your use of them is governed by their own terms and policies.

If you use Color Lock on Reddit, your use is also subject to Reddit's User Agreement and Content Policy.

8. Disclaimers of Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE BANANA STANDARD LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.

10. Indemnification

You agree to defend, indemnify, and hold harmless The Banana Standard LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us, or if we discontinue the Services. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

12. DMCA Takedown

If you believe content on the Services infringes your copyright, please send a notice to anthony@thebananastandard.xyz that includes:

  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the allegedly infringing material and its location on the Services.
  • Your contact information (name, address, phone, email).
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
  • Your physical or electronic signature.

13. Governing Law

These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. The exclusive venue for any dispute that proceeds in court will be the state and federal courts located in North Carolina, and you consent to personal jurisdiction in those courts.

14. Dispute Resolution

We prefer to resolve disputes informally. Before filing a claim, please contact us at anthony@thebananastandard.xyz and give us a reasonable opportunity to address the issue. These Terms do not require mandatory arbitration and do not waive your right to participate in a class action. You retain all rights to pursue claims in court, including small-claims court where eligible.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date below and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
